The One Thing You MUST Do Before You File Bankruptcy
In truth there are several things you must do before filing, but credit counseling is chief among them. You absolutely must complete a credit counseling course from an approved provider before you file. Your certificate must be filed along with your bankruptcy petition, statement of social security number, verification of master address list, and creditor matrix.
Credit counseling is not difficult. You can take the course online or over the phone. However, phone providers generally charge more than online providers. I recommend that clients take the $10 online credit counseling course from Debtor CC. As soon as your course is completed both you and your attorney will receive a certificate by email.
In all chapter 7 and chapter 13 bankruptcy cases you must complete credit counseling, even if you need to file an emergency bankruptcy petition. When I receive a call from someone who needs to file bankruptcy that same day I have them complete the course before they come into the office. By completing the course in advance I can pull a credit report, draft the creditor matrix in the office, and attach their credit counseling certificate. The client can sign their bare bones petition in the office and we can file the case right away to stop foreclosure, wage garnishment, or a lawsuit.
